In May 2020 the Advertising Standards Authority upheld every complaint about a prize promotion by Hydro Solutions Fylde Ltd, trading as Elite Competitions. This page sets out what it ruled, with a link to the ruling.
What the ASA found
- Free entry route. The ad said only “see terms and conditions for free entry method” and did not link to the terms. The ASA found that not prominent enough.
- Closing date. The date was extended if tickets didn’t sell out. The ASA found unsold tickets were not “unavoidable circumstances outside the control of the advertiser”, even though the extensions were disclosed.
- Cash alternative. A prize of 70% of ticket sales was “not a reasonable equivalent to the first prize of £10,000”.
- Response. The ASA also found a breach for unreasonable delay because the advertiser gave no substantive response to its enquiries.
