On 2 December 2020 the Advertising Standards Authority upheld all three complaints about a KS Competitions Ltd promotion for a “Cloud Nine Set”. This page sets out what it ruled, with a link to the ruling.
What the ASA found
- Free entry route. The ad carried only “Look up T&C’s for free entry method” in small text, with no link to the terms. The ASA said the route should be explained clearly and prominently.
- Extension. The closing date could be extended, up to four times, if tickets weren’t sold. The ASA found that “not selling all available tickets did not constitute unavoidable circumstances outside of the advertisers’ control”.
- Cash alternative. If not all tickets sold, the winner would get “a cash prize of 70% of all the tickets bought” instead of the advertised set. The ASA said that was not enough to dispel the impression that entrants were competing for the advertised prize.
